General conditions of sale to customers

A-Preamble:

The Love Madagascar Company, whose main activity is the tourist promotion of hotels and restaurants based on the Malagasy island, to easily connect customers and the service providers they wish to solicit

B- Conditions relating to the customer:

  • Certify that you are at least 18 years old to access this site
  • Declare on honor that all the information that the customer will be required to provide is accurate, and that in the event of any error, his sole responsibility will be retained
  • Acknowledge having read our services
  • Undertake to comply with these terms of the provisions set out
  • Comply with the laws in force on Malagasy soil
  • Make payment for contracted services

C- Conditions relating to our platform :

  • (make a brief legal presentation of your Company concerning its registered office, NIF, STAT and legal form)
  • Our service consists in making known to the public the various networks of local service providers, but at no time will we have any third party links with the conclusion of contracts between them, and the customer wishing to use their services.
  • The advertising of the services of these so-called operators is made solely to facilitate the exchange between the customer and the service provider, but in no case do we offer services in our name and on our personal account.
  • We strive as much as possible to verify the veracity of the information provided by the service providers.

D- Reasons for exemption from liability:

  • Our task is to put the customer in contact with the service provider of his choice, but we cannot answer for the quality of the service provided by the processing service.
  • Any inaccurate data brought to the attention of the customer by the service provider can only be attributed to him alone, for fraudulent maneuver or false allegation.
  • We are and will remain a third party regarding the provisions of the contract that will bind the service provider and the customer
  • Our civil and criminal liability cannot therefore be engaged in any way, for faults committed by one (service provider) or the other (customer), being outside the conclusion of the contract, and therefore consequently , from the effect of its terms

E- Our services:

  • Promote the tourism sector in Madagascar
  • Present various economic operators on our site
  • Allow to connect customers and the service desired by the latter

F- Platform Policy :

  • By accepting the general terms of the platform, the conditions are binding on the parties in the same way as the law
  • They must perform it in good faith, in the sense they intended to give it
  • They can only revoke or modify it with their mutual consent or for causes authorized by law.
  • Any transaction made must be done seriously, and any action tending to the cancellation of a reservation, or in the event of a possible delay in payment or arrival would in no way fall within our competence, but the settlement of this problem could not be done only between the service provider and the customer
  • Hoaxes are strongly prohibited, under penalty of incurring your civil liability, giving rise to damages
  • Any disparagement or unjustified attack on our site will also engage the civil liability of the offender, giving the right to civil compensation.

H- Case of cancellation of reservation

(Being a bilateral agreement between you and the company(ies) with which you will have to deal, it can only be defined by mutual agreement between you, at the risk of a possible disagreement, something for which I do not did not set the conditions)

  • Jurisdiction:
  • Disputes relating to supplies, works, rentals, leases of work or industry, may be brought before the judge of the place where the agreement was contracted or executed, when a party is domiciled in this place.
  • The claim for compensation for damage caused by an offence, a contravention or a quasi-offence, may be brought before the court of the place where the harmful event occurred.
  • In matters of contractual and quasi-contractual obligation, the court seized seeks out and applies the law under which the parties have intended to place themselves.
  • In terms of delictual and quasi-delictual obligation, the law of the place of the delict or quasi-delict is only applicable.
